Register a Lien

In Ontario, a lien must be registered (preserved) at the Land Titles Office within 60 days from the date the work is completed or the materials supplied to the project job site
 
Our service includes:

Perfect a lien

In order to enforce a lien, a statement of claim (lawsuit) has to be filed with the court within 90 days after the lien preservation deadline.
 
Service includes:

  • Service of statement of claim via registered mail.

Julian Prieto completed received his JD from McGill University in Montreal, and founded Just Done Law professional corporation in 2021. During his legal career, Julian has represented construction firms in enforcing their lien rights, and landlords in vacating liens when statutory deadlines are not met. He holds an M.Sc. in Mathematics from Oxford University and a BSc from the University of Toronto.

Disbursements are expenses paid on your behalf and separate from lawyer fees. These include, government registration fees, court filing charges and mailing costs.

The Ontario Construction act 14 (1) states “A person who supplies services or materials to an improvement for an owner, contractor or subcontractor, has a lien upon the interest of the owner in the premises improved for the price of those services or materials.” 

  1. Registration (preservation) deadline: 60 Days from the day the work was completed
  2. Perfection (filing statement of claim with the court) deadline : 90 days from the last day a lien could have been registered (preserved)

If the deadlines for preservation/perfection have not been met, a lawyer can apply to discharge the lien directly to the land registry. Alternatively, an order from the court may be required.
